Introduction

Welcome to ELEVATEX, a product and service provided by ELEVATEX Simulations LLC, a limited liability company registered in the State of Wyoming, United States (“ELEVATEX,” “we,” “our,” or “us”). These Terms of Service (“Terms”) govern your access to and use of our flight tracking and visualization software, including our web application, Windows application, and related services (collectively, the “Service”).

Please read these Terms carefully before using the Service. By accessing or using our Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Use of the Service
1.1 Eligibility
You must be at least 13 years old (or the minimum age required in your jurisdiction) to use the Service. By using the Service, you represent and warrant that you meet these requirements.
1.2 Simulation Use Only
Our Service is intended for use with flight simulation platforms such as Microsoft Flight Simulator (MSFS) and similar products. It is not intended for real-world flight planning, navigation, or tracking and must not be used in actual flight operations.
2. Use of the Service
To access our services, you need to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
3. Restrictions
You agree not to:
  • Use the Service for any illegal purpose or in violation of any laws;

  • Use the Service for any real-world aviation or safety-critical application.

To the maximum extent permitted by law, ELEVATEX Simulations LLC shall not be liable for any indirect, incidental, special, or consequential damages, including lost profits, loss of data, or other intangible losses, arising from your use or inability to use the Service.

Engage in any behavior that is abusive, harassing, defamatory, threatening, or discriminatory toward other users or ELEVATEX staff, including through any community forums, chats, or messaging systems associated with the Service.

Post, upload, or transmit any content that is obscene, pornographic, offensive, or otherwise inappropriate, including but not limited to hate speech, discriminatory content, or material that violates the rights of others.
9.4 Disruptive Behavior
Engage in any activity that could disrupt, overload, or impair the functioning of the Service, including spamming, flooding, or other disruptive actions. You agree not to interfere with or disrupt the servers or networks connected to the Service.
9.5 Impersonation

Use or integrate unauthorized third-party software or services with the Service in a way that could negatively impact the user experience or violate any applicable laws or regulations.
9.7 Use for Real-World Aviation
Use the Service for any real-world flight operations, navigation, or any aviation-related activities outside of the simulation context. The Service is solely for entertainment and simulation purposes.
10. Changes to Terms
We may update these Terms from time to time. If we make material changes, we will provide notice (e.g., via our website or email). Continued use of the Service after changes means you accept the updated Terms.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to conflict of laws principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of courts located in Wyoming.
